LARP — End User License Agreement

This End User License Agreement (the "EULA") is the licence for the LARP iOS app — the software on your device: this document covers the app itself, while the Terms of Service cover everything you do through it — listings, bookings, payments, deposits, cancellations and Sessions. LARP is a marketplace for stationary specialty-vehicle photo and video sessions: nobody drives, and the Owner stays with the parked Car and keeps the keys. Downloading, installing, or using the app means you accept this EULA; if you do not agree with it, do not install or use the app, and delete it if you already have.
1. Who this agreement is between
1.1 This EULA is between you and Larp Marketplace LLC, a California limited liability company, 8030 Lorraine Ave, 303, Stockton, CA 95210, United States ("LARP," "we," "us," or "our").
1.2 It is not an agreement with Apple. LARP, not Apple Inc., is solely responsible for the app and its content. Section 7 sets out the App Store terms that apply on top of this EULA.
1.3 This EULA replaces any earlier end-user licence text published for the LARP app.
2. The licence we grant you
2.1 The grant. Subject to your compliance with this EULA and the Terms of Service, LARP grants you a revocable, non-exclusive, non-transferable, non-sublicensable, personal licence to download and use one copy of the LARP app, in object code form, on Apple-branded devices that you own or control — including through Family Sharing where the App Store Usage Rules allow it.
2.2 Personal to you. The licence is personal to you: it is for your own use of LARP, whether you book Sessions as a Creator or list a Car as an Owner. You may use the app for your work — the restriction is that you may not pass the licence on to someone else or let others use the app under your account.
2.3 Updates. This licence also covers updates and new versions of the app that LARP makes available, unless an update comes with its own licence — in which case that licence governs the update.
2.4 Platform. The LARP app is currently offered for iOS only, through the Apple App Store. There is no Android app today. If LARP releases one, the equivalent Google Play terms will apply to it and this EULA will be updated.
3. The app is licensed, not sold
3.1 You are licensed to use the app — you do not buy it and you do not own it. LARP and its licensors keep all right, title, and interest in the app, including all intellectual-property rights in the software, its design, the LARP name and logo, and all related documentation. All rights not expressly granted in Section 2 are reserved.
3.2 The app is free to download, and there are no subscriptions and no in-app purchases. What you pay for is a Session you book — a real-world service — and that payment runs through Stripe under the Terms of Service and the Fees & Pricing Policy, not through App Store billing.
4. What you may not do with the app
You may not, and may not allow anyone else to:
- Reverse engineer — decompile, disassemble, decrypt, or otherwise try to derive the source code, underlying ideas, or algorithms of the app, or modify, translate, adapt, or create derivative works of it, except to the narrow extent this restriction cannot lawfully be enforced against you.
- Redistribute it — copy (beyond ordinary backups on devices you own or control), sell, resell, lease, lend, hire out, sublicense, assign, publish, or otherwise make the app available to third parties. If you sell or give away a device, remove the app from it first.
- Automate against it — run bots, crawlers, scrapers, or any automated process against the app or the systems behind it, or harvest or extract listings, photos, prices, messages, or user information in bulk, without our prior written permission.
- Build a competitor — use the app, or anything you obtain through it, to build, train, or operate a competing or substantially similar product or service.
- Circumvent controls — bypass, disable, or interfere with security features, authentication, rate limits, or access controls; probe or load-test our systems; or interfere with the app's operation or anyone else's use of it.
- Strip notices — remove, obscure, or alter any copyright, trademark, or other proprietary notice in the app.
- Break the law — use the app for anything unlawful, or in any way that breaches this EULA, the Terms of Service, the Community Guidelines, or the App Store Usage Rules.
Nothing in this EULA is meant to restrict third-party terms that separately apply to you; you are responsible for complying with those as well.
5. Your account, your content, and your privacy
5.1 Your account and your bookings — including who may use LARP (18+), what happens on a Session, cancellations, refunds, and the refundable security deposit — are governed by the Terms of Service, the Cancellation & Refund Policy, and the Damage, Holds & Disputes Policy, not by this EULA.
5.2 Photos, videos, and anything else you post through the app are governed by the Content & Releases Policy and the Community Guidelines. This EULA does not take any ownership of your content.
5.3 What the app collects and why is described in the Privacy Policy; identity verification, which is required only to publish a listing, is described in the Identity Verification & Trust Policy and the Biometric Consent Notice.
6. Updates, changes, and availability
6.1 We may release updates that fix bugs, add or remove features, or change how the app works. Some updates may be required for the app to keep working with our systems. We do not promise that any particular update will be made, or that the app will always be available or uninterrupted.
6.2 The app needs a supported version of iOS and an internet connection. It is your responsibility to confirm that your device meets the requirements shown on the App Store listing; we may change those requirements as the app evolves.
7. Apple App Store terms
Because you get the app from the Apple App Store, the following terms apply in addition to the rest of this EULA. Where they conflict with anything else here, these terms control for App Store purposes. (These mirror §19 of the Terms of Service.)
7.1 This EULA is with LARP, not Apple. Apple is not a party to it, and LARP — not Apple — is solely responsible for the app and its content.
7.2 Scope of licence. Your licence is a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This EULA does not provide usage rules that conflict with those Usage Rules.
7.3 Maintenance and support. LARP is solely responsible for any maintenance and support for the app, and you can reach us at admin@larp.global. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
7.4 Warranty. To the extent any warranty is not effectively disclaimed, if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app — which for the LARP app is nothing, since it is free to download. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are LARP's responsibility.
7.5 Product claims. LARP, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including (i) product-liability claims; (ii) any claim that the app fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
7.6 Intellectual-property claims. If a third party claims that the app, or your possession and use of it, infringes that third party's intellectual-property rights, LARP — not Apple — is solely responsible for the investigation, defence, settlement, and discharge of that claim.
7.7 Legal compliance and export. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist-supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with applicable U.S. and other export-control laws when using the app.
7.8 Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of it, Apple will have the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
7.9 Payments are for real-world services. Sessions are real-world services consumed in person and are paid through Stripe, outside App Store billing, consistent with Apple's policies for real-world goods and services.
7.10 Store terms. Your use of the app is also subject to the Apple App Store terms.
8. Third-party services the app depends on
The app does not work on its own. It relies on Supabase (database, sign-in, and file storage), Stripe (payments, payouts, and Stripe Identity verification), and Expo (push notifications); sign-in is offered through Google and Apple. Those providers handle data as described in the Privacy Policy. Their own terms may apply to you separately, and this EULA does not override them.
9. Ending this licence
9.1 Term. This licence runs until it is terminated — by you or by LARP.
9.2 You can end it at any time by deleting the app from your devices. Deleting the app does not delete your LARP account; to delete the account and the data tied to it, follow the account-deletion instructions.
9.3 We can end it if you breach this EULA — your rights terminate automatically, without notice — and we may also suspend or terminate your access under the Terms of Service.
9.4 What happens then. On termination you must stop using the app and delete all copies of it. Bookings that are already in flight do not simply vanish: money already paid, refunds, and the refundable security deposit are settled under the Terms of Service, the Cancellation & Refund Policy, and the Damage, Holds & Disputes Policy.
9.5 What survives. Sections 3 (licensed not sold), 4 (restrictions), 7 (App Store terms), 9.4, 10, and 11 survive termination.
10. Governing law and disputes
10.1 This EULA is governed by the laws of the State of California, without regard to its conflict-of-laws rules.
10.2 Disputes about the app are handled the same way as disputes about the rest of LARP. The dispute-resolution section of the Terms of Service (§17) applies to this EULA and is incorporated by reference: informal resolution first, then binding individual arbitration administered by the American Arbitration Association, seated in San Joaquin County, California, with a class-action and jury-trial waiver. That section also contains the 30-day opt-out and the carve-outs for small-claims court and for claims seeking injunctive relief or protecting intellectual property. Please read it — it affects how disputes between you and LARP are resolved.
10.3 Subject to §10.2, venue lies in San Joaquin County, California.
11. General
11.1 How this fits with the Terms of Service. For questions about the software licence, this EULA controls. For questions about the marketplace — listings, bookings, Sessions, payments, deposits, cancellations, disputes, and everyone's conduct — the Terms of Service control, and they prevail over this EULA in the event of a conflict, except where Section 7 controls for App Store purposes.
11.2 Warranties and liability. The warranty disclaimers and limitations of liability in the Terms of Service apply to the app and to this EULA. LARP provides no insurance and no host guarantee.
11.3 Changes. We may update this EULA. When we do, we will post the revised version here with a new "Last updated" date; material changes will be notified as described in the Terms of Service. Continuing to use the app after a change means you accept the updated EULA.
11.4 Severability and waiver. If any provision is held invalid or unenforceable, the rest stays in force and the invalid provision is applied as closely as possible to its original intent. A delay in enforcing this EULA is not a waiver.
11.5 Assignment. You may not assign or transfer this EULA. We may assign it in connection with a merger, acquisition, or sale of assets.
11.6 Entire agreement. This EULA, together with the Terms of Service and the policies it links to, is the entire agreement between you and LARP about the LARP app.
